CASE TITLE: CASE TYPE:

Civil - Unlimited  PI/PD/WD - Auto Discovery Hearing 37-2023-00044732-CU-PA-CTL CRANDLE VS FLORES-CASTOR [IMAGED] CAUSAL DOCUMENT/DATE FILED:

Plaintiff's unopposed Motion to Compel Defendant's Response to Discovery (ROA 16) is MOOT, except as to the issue of sanctions, in light of Plaintiff's reply papers confirming belated responses were served.

The court grants Plaintiff's request for sanctions since Plaintiff had to file a motion to obtain Defendant's compliance with her discovery obligations. (Code Civ. Proc. § 2023.030(d), (i).) Since Defendant did serve belated responses well before this hearing, and did not oppose the motion, the court believes that an award of $760.00 is appropriate. The court did not consider the additional sanctions request contained in Plaintiff's reply papers, as Defendant had no opportunity to oppose it.

Defendant is to pay sanctions to Plaintiff in the amount of $760.00 on or before July 19, 2024.

Once confirmed, this ruling shall be the final ruling of the court and no further written order is required.
