Defendant 421 Grand, Inc.'s unopposed Motion to Transfer (ROA 12) is GRANTED.

Defendant has offered evidence that venue is not proper in the Central County Division of San Diego County Superior Court and is proper in the North County Division. (Deroze Decl. at ¶¶ 2, 4.) This evidence was not disputed by Plaintiff, as the motion is unopposed. Plaintiff's complaint in fact specifically alleges that the incident occurred on Defendant's premises in Carlsbad. See San Diego Superior Court Rule 1.2.2.C.

Accordingly, the court orders this action to be transferred to the North County Division of San Diego County Superior Court.

The case management conference concurrently set with this motion and all other dates are ordered VACATED, to be re-set after the case has been reassigned.

Once confirmed, this ruling shall become the final ruling of the court and no further written order is required.
