Plaintiffs' motion to compel the deposition of Peter S. Curry (ROA # 357) is granted as set forth below.

The court directs Peter S. Curry, as a percipient witness, to appear for a deposition on January 4, 2024 at 10:00 a.m. by remote video or at a physical location selected by Mr. Curry. The parties may agree to change the date, time, place and/or remote platform of the deposition. In the absence of any such agreement, the deposition shall occur as indicated in this order.

As a percipient witness, Mr. Curry is not required to answer questions that call for expert opinion testimony.

Plaintiffs' questioning of Mr. Curry shall not exceed one hour. Plaintiffs' counsel and Mr. Curry may agree to a different time frame. In the absence of any such agreement, plaintiffs' questioning shall be limited to one hour. The court retains jurisdiction to allow additional questioning beyond the one-hour limitation if the court determines in the future that additional time is warranted.

This minute order constitutes the court's order. No party is required to submit a proposed order after hearing.

This is the tentative ruling for an appearance hearing (in person or remote) at 1:30 p.m. on Monday, December 18, 2023. If not party appears at the hearing, this tentative ruling will become the order of the court as of December 18, 2023. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
