Civil - Unlimited  Breach of Contract/Warranty Motion Hearing (Civil) 37-2021-00044254-CU-BC-NC INFINITY ENERGY INC VS SEALEY [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion to Be Relieved as Counsel of Record, 12/06/2023

Attorney Benjamin D. Koegel's unopposed motion to be relieved as counsel for plaintiff Infinity Energy, Inc. (ROA # 91) is granted. Attorney Koegel is directed to serve a copy of the signed order on plaintiff Infinity Energy, Inc. Attorney Koegel and the law firm of Elfuindy, Meyer & Koegel, APC are relieved upon the filing of a proof of service showing service of the signed order on plaintiff Infinity Energy, Inc.

Attorney Koegel is also directed to serve a copy of this minute order on Infinity Energy, Inc.

Infinity Energy, Inc. is advised as follows: (1) a corporation may appear in court only through an attorney.

See Clean Air Transport Systems v. San Mateo County Transit Dist. (1988) 198 Cal.App.3d 576, 578-579. Since Infinity Energy, Inc. is a corporation, it is required to have an attorney in order to participate in this lawsuit; and (2) Infinity Energy, Inc. should promptly consult with, and retain, an attorney to represent its interests in this lawsuit. The new attorney should promptly file a notice of appearance. If Infinity Energy, Inc. fails to retain a new attorney, or if the new attorney fails to file a notice of appearance, Infinity Energy, Inc.'s complaint (ROA # 1) may be stricken, and the case may proceed without participation by Infinity Energy, Inc.

This is the tentative ruling for an appearance hearing (in person or remote) at 1:30 p.m. on Wednesday, January 31, 2024. If no party appears at the hearing, this tentative ruling will become the order of the court as of January 31, 2024. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
