Defendant Bryan David Ramirez' motion to compel discovery responses (ROA # 38) is granted.
Defendant propounded discovery requests (request for production of documents, form interrogatories and special interrogatories) on plaintiff Pascual Corrales Galo on March 3, 2023. See Landrith Dec.
(ROA # 38), ¶ 2. Defendant indicates that no responses have been received. Id. at ¶ 6.
Plaintiff Pascual Corrales Galo is ordered to provide verified responses to the Form Interrogatories, Special Interrogatories and Request for Production of Documents pursuant to CCP §§ 2030.290(b) and 2031.300(b). By failing to respond to the interrogatories and inspection demand in a timely fashion, plaintiff has waived the right to assert objections pursuant to CCP §§ 2030.290(a) and 2031.300(a).
Plaintiff Pascual Corrales Galo's verified responses must be sent to Attorney Kevin S. Landrith at Law Office of Brooke E. Montgomery, 14111 Danielson Street, Suite 100, Poway, California 92064 by no later than October 13, 2023.
The request for sanctions is granted pursuant to CCP §§ 2030.300(d) and 2023.010(h) in the amount of $660 (five hours at $120/hour and $60 for the filing fee). The sanctions shall be paid by plaintiff Pascual Corrales Galo to defendant Bryan David Ramirez on or before October 29, 2023.
This is the tentative ruling for an appearance (in person or remote) hearing at 1:30 p.m. on Friday, September 29, 2023. If no party appears at the hearing, this tentative ruling will become the order of the court as of September 29, 2023. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
