Defendant's MV Transportation, Inc.'s unopposed demurrer (ROA # 55) to the first cause of action (Labor Code ยง 1102.5) is sustained without leave to amend. Defendant's motion to strike (ROA # 52) is granted. The court deems the lack of opposition to be a concession as to the merits of the demurrer and motion to strike. In addition, notwithstanding the lack of opposition, the court has reviewed the papers and finds that the demurrer and motion to strike are meritorious.
If plaintiff's counsel appears (in person or remotely) at the hearing and requests leave to amend, the court will give due consideration that request.
The court requests that MV Transportation's counsel contact plaintiff's counsel in advance of the hearing to determine whether plaintiff intends to appear at the hearing.
