Plaintiffs Pacific Coast Builder, Inc. and Matt Gross' motion to compel the deposition of defendant General Motors, LLC's person most qualified (ROA # 26) is granted in part as set forth below.
The court directs defendant's person most qualified to appear for a deposition on October 30, 2023 at 10:00 am at Cline, APC, 7855 Ivanhoe Avenue, Suite 408, La Jolla, California 92037 or by remote video.
The parties may agree to change the date, time and/or place of the deposition. In the absence of any such agreement, the deposition shall occur as indicated in this order.
Defendant's person most qualified is directed to produce the documents requested in the deposition notice.
It is unnecessary at this time to resolve potential disputes concerning the scope of the deposition. If the person most knowledgeable fails to respond to appropriate questions at the deposition, then plaintiffs may bring a further motion to compel. The court requests that the parties work in good faith at the deposition to resolve any disputes concerning the scope of the deposition. The court reserves jurisdiction to make further orders concerning any disputes that may arise or exist at the deposition.
Plaintiffs' request for monetary sanctions in the amount of $3,619.00 is granted as against defendant General Motors, LLC.
This is the tentative ruling for an appearance hearing (in person or remote) at 1:30 p.m. on Friday, October 13, 2023. If no party appears at the hearing, this tentative ruling will become the order of the court as of October 13, 2023. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
