Attorney Devon R. Franza's unopposed motion to be relieved as counsel for plaintiff Japanese Auto Tech, LLC (ROA # 13) is granted. Attorney Franza is directed to serve a copy of the signed order on plaintiff Japanese Auto Tech, LLC. Attorney Franza and Dillon Miller Ahuja & Boss, LLP are relieved upon the filing of a proof of service showing service of the signed order on plaintiff Japanese Auto Tech, LLC.
Japanese Auto Tech, LLC is advised as follows: (1) A limited liability company may appear in court only through an attorney. See Clean Air Transport Systems v. San Mateo County Transit Dist. (1988) 198 Cal.App.3d 576, 578-579. Since Japanese Auto Tech, LLC is a limited liability company, it is required to have an attorney in order to participate in this lawsuit; and (2) Japanese Auto Tech, LLC should promptly consult with, and retain, an attorney to represent its interests in this lawsuit. The new attorney should promptly file a notice of appearance. If Japanese Auto Tech, LLC fails to retain a new attorney, or if the new attorney fails to file a notice of appearance, Japanese Auto Tech, LLC's complaint (ROA # 1) and answer (ROA # 11) may be stricken, and the case may proceed without participation by Japanese Auto Tech, LLC.
Attorney Franza is directed to serve a copy of this minute order on Japanese Auto Tech, LLC.
This is the tentative ruling for an appearance hearing (in person or remote) at 1:30 p.m. on Friday, July 14, 2023. If no party appears at the hearing, this tentative ruling will become the order of the Court as of July 14, 2023.
