Defendant Novoron Bioscience, Inc. and specially appearing defendants Jason A. Young and Codebiosys, Inc.'s motions to stay this action (ROA #'s 138 and 149) are granted as set forth below.

Defendant David Motes request for joinder (ROA # 144) is granted.

The court has carefully considered the arguments and authorities presented by the parties. The court believes that, in the interest of efficiency and for purposes of controlling the court's own calendar, this lawsuit should be stayed for an initial period of six months so that the court and the parties can determine what actions, if any, are pursued and determined in Delaware. However, the court exempts from the stay the agreed-upon discovery from defendant Motes and any related motions pertaining to that discovery.

Any party that desires to have the stay lifted may appear ex parte (after proper notice) to request that the stay be lifted. However, in the absence of unforeseen circumstances, the court does not expect to lift the stay during the next six months. In connection with any request to lift the stay, the court anticipates inquiring as to the status of any related litigation in Delaware.

This minute order constitutes the court's order. No party is required to submit a proposed order after hearing.

This is the tentative ruling for an appearance hearing (in person or remote) at 2:30 p.m. on Friday, January 12, 2024. If no party appears at the hearing, this tentative ruling will become the order of the court as of January 12, 2024. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
