This matter is before the court to address whether the case is, or should be, stayed in light of defendant's appeal of the order denying defendant's motion to compel arbitration.

After careful consideration of the issue, the court concludes that (1) the case is not automatically stayed in its entirety by virtue of the appeal, (2) the court should not exercise its discretion to stay the case in its entirety at this time. The court also concludes that no trial date should be set at this time. But it is reasonable and appropriate to allow the parties the opportunity to take discovery should they elect to do so. Of course, no party is required to take discovery. Each party may choose for itself whether they wish to take discovery.

This minute order constitutes the court's order. No party is required to submit a proposed order after hearing.

This is the tentative ruling for an appearance hearing (in person or remote) at 2:30 p.m. on Monday, December 18, 2023. If no party appears at the hearing, this tentative ruling will become the order of the court as of December 18, 2023. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
