Plaintiff Pure Turbos, Inc.'s motion to compel discovery responses (ROA # 75) is granted.
Plaintiff propounded discovery requests (request for production of documents, form interrogatories and special interrogatories) on defendants Charles Sager, Jr. and Elite Turbo Concepts, LLC on June 28, 2023. See Ward Dec. (ROA # 76), ¶¶ 3-4. Plaintiff indicates that no responses have been received. Id. at ¶ 12.
Defendants Charles Sager, Jr. and Elite Turbo Concepts, LLC are ordered to provide verified responses to the Form Interrogatories, Special Interrogatories and Request for Production of Documents pursuant to CCP §§ 2030.290(b) and 2031.300(b). By failing to respond to the interrogatories and inspection demand in a timely fashion, defendants have waived the right to assert objections pursuant to CCP §§ 2030.290(a) and 2031.300(a). Defendants Charles Sager, Jr. and Elite Turbo Concepts, LLC's verified responses must be sent to Attorney Danielle Ward at the Blake Law Firm, 533 2nd Street, #250, Encinitas, California 92024 by no later than October 13, 2023.
The request for sanctions is granted in the amount of $1,972.50 (4.5 hours at $425/hour and $60 for the filing fee). The sanctions shall be paid by defendants Charles Sager, Jr. and Elite Turbo Concepts, LLC, jointly and severally, to plaintiff Pure Turbos, Inc. on or before October 29, 2023.
This is the tentative ruling for an appearance (in person or remote) hearing at 1:30 p.m. on Friday, September 29, 2023. If no party appears at the hearing, this tentative ruling will become the order of the court as of September 29, 2023. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
