Defendant Charles Sager's motion to quash deposition subpoena (ROA # 72) is denied as set forth below.

Defendant moves to quash a subpoena propounded by plaintiff Pure Turbos, Inc. seeking defendant's bank records from US Bancorp. Alliance Decl. (ROA # 72), Ex. 1.

The court will conduct an in camera review of the subpoenaed records to determine which records, if any, should be made available to the plaintiff.

The court orders that the subpoenaed records be produced to the deposition officer for copying by January 12, 2024. The deposition officer shall then send the records directly to the court for in camera review. The deposition officer shall not release any records to plaintiff without further court order. The deposition officer may release a set of the records to defense counsel.

The court will conduct a further hearing on this matter on February 2, 2024 at 2:30 pm. The court anticipates receiving and reviewing the records in camera before that next hearing. The court requests that defense counsel do the following: (1) review the records before the February 2, 2024 hearing, and release to plaintiff's counsel those records as to which defendant has no objection; and (2) appear (in person or remote) at the February 2, 2024 hearing prepared to discuss any objections to any records that have been withheld from plaintiff's counsel.

If the parties have not already done so, the court encourages them to stipulate to a protective order that would be available to govern the use and dissemination of discovery materials that may contain sensitive or private information.

The court requests that plaintiff's counsel serve a copy of this order on US Bancorp and the deposition officer.

This minute order constitutes the court's order. No party is required to submit a proposed order after hearing.

This is the tentative ruling for an appearance (in person or remote) hearing at 2:30 p.m. on Friday, December 22, 2023. If no party appears at the hearing, this tentative ruling will become the order of the court as of December 22, 2023.
