Defendant Reynaldo Gonzalez Chavez and Catalina Gonzalez's motions to quash subpoenas (ROA # 26 and #30) are granted without prejudice to plaintiffs issuing new subpoenas that identify an independent third-party as the deposition officer.
The current subpoenas identify plaintiff's counsel as the deposition officer. The court believes that an independent third-party should be identified as the deposition officer. This will facilitate an in camera review of the subpoenaed records without the records being disclosed to plaintiff's counsel in the first instance.
If new subpoenas are issued, the court anticipates directing that the subpoenaed records be provided to the court for in camera review. After conducting an in camera review, the court will determine which records, if any, should be provided to plaintiffs.
If the parties have not already done so, the court requests that the parties meet and confer to attempt to agree on a stipulated protective order. It is appropriate to have a protective order in this case to govern the use of evidence that may contain private information.
This minute order constitutes the court's order. No party is required to submit a proposed order after hearing.
This is the tentative ruling for an appearance (in person or remote) hearing at 1:30 p.m. on Tuesday, March 19, 2024. If no party appears at the hearing, this tentative ruling will become the order of the court as of March 19, 2024. If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
