¿           Plaintiff filed a statement of non-opposition to the Demurrer, conceding the merits of the demurring defendant’s assertion that the second cause of action for forcible detainer fails to allege the mandatory 5-day notice period before filing suit.  Unless Plaintiffs assert at the hearing that they can truthfully allege in a future amended pleading that the pre-suit notice was actually given, or can truthfully allege the other missing ingredients of a forcible detainer claim, the demurrer will be sustained without leave to amend.
