On the afternoon of August 8, 2023, a half-day before the hearing set on this motion, most of the parties signed off on a stipulation to continue the hearing on the motion to contest good faith of the settlement to early September, in light of pending global settlement of this and another action among the parties.  Mr. Berger did not sign either copy of the stipulation filed with the Court, however.  The Court will discuss with counsel whether Mr. Berger’s signature should be an impediment to postponement of the hearings and of the CMC, but the Court’s tentative is to continue the hearings to September 13, 2023 at 8:30 a.m.
