Tentative Ruling: (1) Grant in part; Court will
advance Hearing Date on Demurrer To March 10
The Landlord Tenant Act contains shortened time periods for
everything; cases are set for trial within 20 days of the landlord’s request
for trial setting once Defendant has appeared; motions for summary judgment are
set on 5 days’ notice, a Defendant is required to respond to the Complaint
within 5 days after service, etc. ¿ While the time period to hear a
demurrer is not specifically addressed in the Landlord-Tenant Act, the Court
infers that expedited hearings on all manner of motions are the legislative
intent. Accordingly, the Court’s tentative
ruling is to advance the hearing on the demurrer from April 5 to March 10, to
allow Defendant time to file and e-serve its reply to the opposition to the
demurrer by 4:30 p.m. on Tuesday March 7, and to conduct the hearing on the demurrer
at 8:30 a.m. on Friday March 10.
