I. BACKGROUND¿¿¿

Plaintiff seeks to cease pending non-judicial foreclosure of a commercial property located in Oakland, California.  There is a dispute between the parties as to whether Plaintiff was given notice of the Trustees Sale and whether Plaintiff should be excused form the tender requirement because of the claimed lack of proper notice.  The Court issued a TRO on the strength of Plaintiff’s one-sided presentation of the facts, and set a hearing so that Defendant could have the opportunity to give its side of the facts.  In Opposition, Paul Briones on November 9, 2023 filed a signed declaration to replace a previous, unsigned one.  The November 9 Briones Declaration attests to the posting of notice of the Trustee’s sale including a photo of the posted notice at the subject property.  At the hearing on this Motion, the Court will consider Plaintiff’s oral or written reply to the signed Briones Declaration but is now appears that Plaintiff has notice of a looming foreclosure sale of the property and that the Court, having slowed the process by granting the TRO, should now dissolve the TRO and allow Defendant to make a tender or pursue its other remedies unencumbered by temporary or preliminary injunctions.
