Plaintiff's Motion for Preliminary Approval of Class and Representative Action Settlement is GRANTED.

(ROA 41.) However, settlement class members are to be provided 90 days from the notice to submit a dispute, object, or opt out of the proposed class action settlement, rather than 45 days.

The final approval hearing is scheduled for May 17, 2024 at 8:30 a.m. in this department. This hearing reservation contemplates one set of moving papers and the papers are to be within the page limits. The moving papers are to be filed per Code.

Plaintiff is to submit a revised proposed order reflecting the above changes and the date of the final approval hearing.

The court has exercised its discretion to consider the oversized memorandum on this occasion.

However, Plaintiff's counsel is to comply with all court rules going forward, including page limits. The court has discretion to refuse to consider papers that exceed the page limit, and the court has addressed the issue of excessive briefing with Plaintiff's counsel's firm on other cases in the past.
