Plaintiff's Motion to Compel the Deposition of Defendants' Person Most Knowledgeable is GRANTED, subject to the limitations set forth below. (ROA 73.) As the court understands it, the parties are in agreement that they intend to stipulate to a protective order and the only impasse between them is Plaintiff's request to include a 'sharing provision' to allow Plaintiff's counsel to share the confidential information with any attorney or individual investigating a claim against Defendants in any future case. The court will not impose this provision on Defendants.
Accordingly, the parties are ordered to submit the proposed stipulated protective order, omitting this provision, on or before September 18, 2023.
In light of this ruling, Defendants' motion for protective order currently set for October 13, 2023 is ordered VACATED as moot.
Defendants also assert the notice of deposition is overbroad. In general, the court finds the proposed areas of inquiry to be relevant and discoverable. However, the court will limit the scope of inquiry into prior accidents in Polaris UTVs to those prior incidents that occurred within ten years prior to the subject incident.
