Defendants noticed a motion for consolidation to be heard on December 15, 2023. (ROA 25.) On May 1, 2023, the court granted Defendants' ex parte application to advance hearing on the motion to consolidate and set the motion for August 25, 2023.

Thereafter, Defendants failed to file and serve notice of the new hearing date. Accordingly, the court's tentative ruling is to deny the motion without prejudice on these grounds.

However, to the extent Plaintiffs' counsel in both the Allison and Layus actions appear at the August 25, 2023 hearing and confirm they are waiving the service defect and are not opposed to consolidation, the court will consider granting the motion.
