Plaintiff MAPFRE Insurance Company's Motion for Summary Judgment is ordered OFF CALENDAR.

(ROA 34.) Plaintiff initially filed a Complaint against Defendants Carole Keaton, John Randall Keaton, Greydon Gerber Sr., and Jordon Gerber on November 10, 2022.

Default was entered against Carole Keaton on March 10, 2023 and against John Randall Keaton on April 13, 2023. (ROA 22, 30.) Plaintiff also dismissed its third and fourth causes of action without prejudice on April 6, 2023. (ROA 27.) Thus, the only remaining causes of action are Plaintiff's first and second causes of action for declaratory relief. Both the first and second causes of action are stated against the Keaton Defendants only.

Accordingly, the court concludes the motion is procedurally improper. At this point, Plaintiff must proceed by way of default.
