Defendant Jordon Gerber's Demurrer to Complaint is OVERRULED. (ROA 15.) The court notes its error in ordering Plaintiff's motion for summary judgment off calendar as against Defendant Gerber on September 1, 2023. Upon further review, the court notes Plaintiff's second cause of action is alleged against Defendant Gerber, and thus the summary judgment motion should have been heard as to this cause of action against Defendant Gerber. Accordingly, the court sets hearing on Plaintiff's Motion for Summary Judgment against Defendant Gerber for December 29, 2023 at 8:30 a.m.

Plaintiff is ordered to timely file and serve notice of the new hearing date. Plaintiff may rely on its previously filed moving papers at ROA 34-40.
