Attorney Connor's Motion to be Relieved as Counsel for Plaintiff Scott Remick, Trustee of the Babbling Moose Trust UTD September 17, 2018 is CONTINUED to December 8, 2023 at 8:30 a.m. (ROA 78.) 'Proof of service of the moving papers must be filed no later than five days before the time appointed for hearing.' (Cal. R. Court, rule 3.1300(c).) 'The notice of motion and motion [to be relieved as counsel], the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case.' (Cal. R. Court, rule 3.1362(d).) Here, Attorney Connor filed a proof of service on October 9, 2023 (late). It indicates Mr. Remick was served by mail. However, no proof of service was filed as to any of the other parties. As such, the court is unable to confirm whether all other parties have been served.

Accordingly, the motion is continued to allow time for service. Attorney Connor is ordered to timely file and serve amended motion papers providing the continued hearing date on the client and all counsel and timely file a proof of service prior to the continued hearing date.
