TENTATIVE RULING

Plaintiff Fnu Jinghui’s Application for an Order for Appearance and Examination of Judgment Debtor Quinghua Huang is GRANTED.

BACKGROUND

This is a contractual fraud action. On December 3, 2020, Plaintiff Fnu Jinghui filed a complaint against Matthew Chiang, Quinhua Huang (Defendant), NE Plus Enterprises, Does 1-20, and NE Plus Corporation. After Defendant entered default, the court entered a default judgment against Defendant on February 8, 2023, in the amount of $2,373,775.

On March 20, 2023, an abstract of judgment was issued and Plaintiff filed the present application on March 21. A hearing is set for May 23, 2023.

ANALYSIS

Plaintiff seeks an order for Defendant to appear for an examination to aid in the enforcement of a money judgment against Defendant. The court agrees.

Pursuant to Code of Civil Procedure section 708.110, subdivision (a), a judgment creditor may apply “for an order requiring the judgment debtor to appear before the court, or before a referee appointed by the court, at a time and place specified in the order, to furnish information to aid in enforcement of the money judgment.”

Here, the court finds Defendant is a judgment debtor and that good cause exists to grant Plaintiff’s application.

Accordingly, Plaintiff’s application is GRANTED.

CONCLUSION

Based on the foregoing, the court GRANTS Plaintiff’s application for an order ordering Defendant to appear for a judgment debtor examination.
