TENTATIVE RULING

The court continues the hearing on Plaintiff’s motions to a date to be determined at the hearing.  Plaintiff is ordered to serve its Motions to Compel Further pursuant to Code of Civil Procedure §§1005 and 1010.6.

Plaintiff served Defendants by electronic mail on April 25, 2025.  The court calculates that Plaintiff did not provide the statutory notice to Defendants required by Code of Civil Procedure §§1005 and 1010.6, which provides for service sixteen (16) court days before the hearing date, or by Monday, April 28, 2025.   Service by email service adds an additional two (2) court days to service. (CCP 1010.6(a)(3)(B).)  Therefore, service by email required Plaintiff to serve Defendants with the motions on or before Thursday, April 24, 2025.

The court also notes that Plaintiff’s Proofs of Service reflect email service on Wang’s counsel and directly on Wang.  Since Wang is represented by counsel, service should not be made directly of Wang.
