TENTATIVE RULING

Petitioner Bill Me Later, Inc.’s Petition to Confirm Contractual Arbitration Award is CONTINUED to a date to be determined at the initial hearing set in Department G (Pomona). Petitioner Bill Me Later, Inc. is further ordered to serve notice of the new hearing date on Respondents T.N Lucky Inc. and Xing Tan pursuant to the requirements of Code of Civil Procedure section 1290.2.

BACKGROUND

This is an action to confirm a contractual arbitration award. On June 21, 2024, Petitioner Bill Me Later, Inc. (BML) filed the present petition to confirm contractual arbitration award against Respondents T.N Lucky Inc. (T.N Lucky) and Xing Tan. On November 10, 2024, BML’s process server served T.N Lucky and Tan with substitute service in West Covina.

A hearing on the present petition is set for January 28, 2025, along with a CMC.

ANALYSIS

BML petitions the court for confirmation of an arbitration award against T.N. Lucky and Tan. For the following reasons, the court CONTINUES the hearing on the present petition.

On November 21, 2024, the court continued a hearing on the present petition from December 12, 2024, to January 28, 2025, and gave notice to BML. While BML filed a notice of continued hearing on November 27, 2024, BML did not provide a proof of service that established such notice had been served on T.N Lucky and Tan.

Accordingly, the hearing on BML’s petition to confirm arbitration award is CONTINUED to a date to be determined at the initial hearing set in Department G (Pomona). BML is further ordered to serve notice of the new hearing date on Respondents pursuant to the requirements of Code of Civil Procedure section 1290.2.
