Tentative: The Court has
reviewed the request for default judgment. The Court is CONTINUING the matter
to allow Plaintiff to correct the following defects:
1. Plaintiff has not
filed a request for default judgment on CIV-100 as required.
2.
Damages have not been proved. The supporting
evidence is not sufficient to prove the amount of damages sought. First, the
medical bills attached do not amount to $8,225. Second, there is no proof that
any future medical treatment is required, such as a doctor’s note, indicating
Plaintiff needs further treatment and the costs of that treatment. As such,
$8,000 for future damages cannot be awarded without such proof.
