TENTATIVE

The Court has reviewed the Expedited Petition to Approve Minor’s Compromise.  The Court declines to approve the Petition as requested.  Pursuant to Cal Rules of Court 7.950.5(c)(3), the Court elects to schedule a hearing date to permit counsel to provide a further declaration in support of the fee request discussing the relevant factors identified in Cal Rules of Court 7.955.  The declaration filed with the petition does not sufficiently substantiate a fee request of 33% of the settlement amount.  The Court would award a lesser amount on the current record, $6,375.00 in attorneys fees.

Additionally, Claimant did not file a proposed order or serve the defendant.

Accordingly, the Court schedules a hearing on this petition for January 5, 2023 at 1:30 p.m. in Department SS-29.  Counsel is ordered to correct the defects and file a supplemental declaration substantiating the fee request by December 21, 2022.

Moving party is ordered to give notice.
