TENTATIVE 

The Court excuses the personal appearance of the claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.  

The Court has reviewed the Petition to Approve Compromise of Disputed Claim of a Minor (Xavier Joe Ruiz, age 9). The Court finds the settlement is reasonable. However, the listed costs and attorney fees only amount to $150,785.75, not $153,785.75 as listed on the petition and orders. Thus, the net settlement should amount to $324,214.25, and not $321,214.25, as listed on the petition and orders. Further, counsel should attach an itemized breakdown of the investigation costs amounting to $19,537 to the new petition.

Counsel is ordered to file a new petition and orders correcting the defects.

Moving party is ordered to give notice.
