TENTATIVE
The Court excuses the personal
appearance of the claimant and the guardian ad litem. Counsel may appear by
telephone or video conference call.
The Court has reviewed the
Petitions to Approve Compromise of Disputed Claim of Minors (Mia Riquiac,
age 7; Brittany Cruz Antonio, age 7; and Destiny Cruz, age 7).
The Court finds the
settlements are reasonable. However, there are various issues precluding the
granting of the petitions at this time.
First, as to Mia’s petition and the proposed orders granting
the petition, after adding the costs and attorney’s fees, the total allowance
from the settlement proceeds should say $7,981.18, and not $8,942.36. As a
result, the balance of the proceeds after payment of all fees and expenses
should accordingly say $20,098.82, and not $19,137.64.
Second, as to the proposed order granting the petition
pertaining to Brittany, costs are listed as $961.18, when they are listed as $988.44 on
her petition.
Third, as to the proposed order granting the petition
pertaining to Destiny, costs are listed as $961.18, when they are listed as $977.69 on
her petition.
Accordingly, the Petitions to Approve Compromise of
Disputed Claim of Minors (Mia Riquiac, age 7; Brittany Cruz Antonio, age
7; and Destiny Cruz, age 7) are
CONTINUED. Counsel is ordered to file a new petition and proposed order as to
Mia and correct the above described defect. Counsel is ordered to file new
proposed orders for Brittany and Destiny correcting the described defect.
Moving party is ordered to give notice.
