TENTATIVE

The Court has reviewed the Expedited Petitions to Approve Minor’s Compromise (Daniela Haro, age 16). The Court declines to approve the Petition as requested. Pursuant to Cal Rules of Court 7.950.5(c)(3), the Court elects to schedule a hearing date to permit counsel to correct the following deficiencies:

(1)  While the medical reports are attached to the petition, the medical bills in the amount of $4,397.73 are not.

(2)  As there has been an agreement to reduce the medical expenses, a copy of that agreement is required to be filed with the petition.

(3)  Defendants have not been served with the petition.

(4)  The proposed order states that total allowance for fees and expenses from the settlement is $435, but the total amount is $8,310. This figure must include the total amount of attorney fees, medical expenses, and costs.

(5)  Petitioner proposes to deposit the settlement proceeds into a blocked account, however, a proposed order to deposit into a blocked account has not been filed.

Accordingly, the Court schedules a hearing on this petition for  April 25, 2023 at 1:30 p.m. in Department SS-29. Counsel is ordered to file supplemental documents including the medical bills, and the reduction agreement for medical bills. Counsel is also ordered to serve the petition on Defendants. Lastly, counsel is ordered to file a new proposed order correcting the amount listed under total allowance and file a proposed order for the blocked account.
