Judge: Serena R. Murillo, Case: 22STCV21262, Date: 2023-01-05 Tentative Ruling

Case Number: 22STCV21262    Hearing Date: January 5, 2023    Dept: 29

TENTATIVE

The Court excuses the personal
appearance of the claimant and the guardian ad litem. Counsel may appear by
telephone or video conference call.

As an initial matter, the
Court notes it has already ruled on the merits of Defendant’s opposition in its
11/29/2022 minute order and thus will not address the same arguments in the
re-filed opposition.

The Court has reviewed the
Petitions to Approve Compromise of Disputed Claim of Minors (R.S.A., age 8,
S.S.A., age 8, and M.S.A., age 13)
. The Court finds the settlements are
reasonable. However, there are various issues precluding the granting of the petitions
at this time.

First, the retainer agreements are not signed.

Second, counsel should obtain a new signature from Petitioner
after the petition is amended. The current signature predates the amended
petition.

Accordingly, the Petitions to Approve Compromise of
Disputed Claim of Minors (R.S.A., age 8, S.S.A., age 8, and M.S.A., age
13)
are CONTINUED. Counsel is ordered to correct the issues described
above.

Moving party is ordered to give notice.
