Sharon Watkins, et al. v. Rosalinda Cervantes

Petition to Approve Compromise of Disputed Claim of a Minor (Lucas Correll, age 17)

TENTATIVE

The Court excuses the personal appearance of the claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.

The Court has reviewed the Petition to Approve Compromise of Disputed Claim of a Minor (Lucas Correll, age 17). The Court finds the settlement is reasonable. However, the following defect preludes the granting of the petition at this time. The listed costs, medical expenses and attorney fees only amount to $9,637.57, not $9,687.57 as listed on the petition and orders. Thus, the net settlement should amount to $8,862.43, and not $8,812.43, as listed on the petition and orders.

Accordingly, the Petition to Approve Compromise of Disputed Claim of a Minor (Lucas Correll, age 17) is CONTINUED TO 11/2/2022 at 1:30 p.m. Counsel is ordered to file a new petition and proposed orders correcting the defect.

On September 6, 2022, counsel was ordered to make the indicated changes, but did not.  The Court calendars an Order to Show Cause why counsel should not be sanctioned for failure to comply with the court's order, hearing to be held concurrently with the continued hearing on the Petition to Approve Compromise of Disputed Claim of a MInor.

Moving party is ordered to give notice.
