TENTATIVE
The Court excuses the personal appearance of the claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.
On September 6, 2022, the Court reviewed the Petition to Approve Compromise of Disputed Claim of a Minor (Lucas Correll, age 17). The Court found the settlement is reasonable. However, the following defect preluded the granting of the petition. The listed costs, medical expenses and attorney fees only amount to $9,637.57, not $9,687.57 as listed on the petition and orders. Thus, the net settlement should amount to $8,862.43, and not $8,812.43, as listed on the petition and orders.
On September 26, 2022, the Court again reviewed the minor’s compromise (filed on September 20, 2022). While counsel filed a new petition and orders, the defects were yet to be corrected.
On November 2, 2022, the matter was continued as a new petition and orders were still filed to correct the defects.
Now, again, counsel has failed to file the new petition and proposed orders.
Accordingly, the Petition to Approve Compromise of Disputed Claim of a Minor (Lucas Correll, age 17) is CONTINUED. Counsel is again ordered to file a new petition and proposed orders correcting the defect.
