Expedited Petition to Approve Compromise of Pending Action of Minor, Natalie Melchor, age 15

TENTATIVE 

 

On 4/28/2022, the Court reviewed the Petitioner’s Expedited Petition to Approve Minor’s (Natalie Melchor, age 15) Compromise without a hearing pursuant to Cal Rules of Court 7.950.5. The Court found the settlement is reasonable, but there are several deficiencies precluding the granting of the petition.

 

First, there is a discrepancy in the amount of medical expenses to be reimbursed from the proceeds. Attachment 13(A) of the petition states that the medical provider agreed to reduce his bill to $273.91, but the medical expenses listed are only $242.92. Further, item 13(a)(4) of the petition also states that the medical expenses were reduced to $273.91, and that is the amount is to be reimbursed from the proceeds of the settlement.  Additionally, item 13(a)(5) of the petition states there is a lien of $704.09.

 

Second, a copy of the parties’ retainer agreement is not attached to the petition.

 

On 7/28/2022, the Court continued the matter to allow counsel to correct the deficiencies. Counsel has yet to correct these deficiencies.

 

The hearing must again be continued so that counsel may correct these errors.  Any further failures by counsel shall result in an Order to Show Cause why the Court should not impose sanctions.
