Tentative rulings: 3/29/2023

 

  1. Motion to withdraw by Mr. Ludwig and his firm is granted contingent on filing proof of service of the conformed order on trustee.
  2. Complaint by Trustee Janna Beyder dismissed without prejudice for failure to have an attorney of record.  Counsel for trustee filed a motion to withdraw on 12/9/2022.  On 1/18/2023, the court ordered as follows:  The court will continue the hearing on the motion to withdraw and Order to Show Cause why the complaint by the trustee should not be dismissed for failure to be represented by an attorney on 3/29/2023 at 8:30 a.m. in Dept. T. At that time, Ms. Beyder is expecting to have a replacement attorney substitute in for her as trustee. If no new attorney has appeared for the trustee, Mr. Ludwig will be allowed to withdraw, and the court thereafter will dismiss the operative complaint for failure of the trustee to be represented by an attorney.  Accordingly, on the filing of the proof of service of the motion to withdraw, the complaint filed by the Trustee on 10/31/2019 is dismissed without prejudice.
  3. The court will discuss orders for David Wald as receiver.
  4. The case is set for the bifurcated jury trial on damages (within 90 days).
