“Settlement Agreement and Mutual Releases” was signed by all parties and
counsel in December 2020. The essence of
the agreement was that defendant would grant plaintiffs the right to 3 parking
spaces and a space for a trash receptacle, subject to the LADBS approving a
Covenant and Site Plan. The actual
denial from the LADBS has not been provided to the court, nor has the site plan,
which was submitted, although it is declared that there was a denial. No exhibits referred to in the Settlement
Agreement were provided. The court needs
to see Exhibits A, B and C to the Settlement Agreement as well as the site plan
submitted to LADBS. If in the possession
of moving parties, then by plaintiffs’ counsel.
If not, then by defense counsel. They
should be delivered to the Clerk in Dept. T forthwith.
