[TENTATIVE] ORDER: Plaintiff Mordechai Elishmerni’s Motion to Tax Costs is GRANTED.
Plaintiff Mordechai Elishmerni (Plaintiff) moved to strike Defendant Eden Sarusi’s (Defendant) Memorandum of Costs.
Discussion
Plaintiff argued that Defendant’s Memo of Costs is untimely per California Rules of Court section 3.1700 because it was filed more than the 15-day limit. The Judgment was entered on August 2, 2022 and the clerk mailed out notice on August 3, 2022. Defendant filed the Cost Memo on September 7, 2022, which is 35 days after service of the notice of judgment. On these facts, the Cost Memo is untimely and Plaintiff’s motion is persuasive.
The Motion to Tax Costs is GRANTED.
