Tentative ruling

Motion for leave to amend

Modaraei v Momeni

20VECV00920

The opposition is not late and will be considered.  9 court days prior to the 12/16/2022 hearing is 12/5/2022.   Two additional court days is 12/1/2022.  The opposition was served and filed on 11/30/2022.  The court notes that prior continuances of the trial date were by agreement.

Questions not answered by the moving papers:

  1. When did plaintiff become aware of Reza Ghazi’s involvement.
  2. How did the plaintiff become aware of Reza Ghazi’s involvement.
  3. Will this result in a request for a trial continuance?  If so, how long?
  4. Why was plaintiff unaware of Reza Ghazi’s involvement at the time the complaint was filed?
  5. Why was motion not filed between 8/23 and 9/20?
  6. Why was the motion not filed between 10/31 and 11/15?
  7. Why was there no ex parte to special set the motion?

Also, will current defendant counsel be representing Reza Ghazi?
