Introduction
Plaintiff/Judgment Creditor MS Services, LLC (Plaintiff) applied for an Order to Show Cause and for Issuance of an Order for Sale of Dwelling against Defendant/Judgment Debtor Kambiz Razaghi (Defendant.) The property at issue is located at 12275 Alta Panorama, Santa Ana, CA 92705, which is in Orange County.
Procedure
The judgment creditor must file the application for an order of sale in the county where the dwelling is located (together with any applicable filing fee; see Govt. Code sec. 70617 (a)). If the dwelling is in a county other than the county in which the judgment was entered, the judgment creditor shall apply to the superior court of the county where the dwelling is located. (Code Civ. Proc. sec. 704.750, subdivision (b)(1).) The property at issue is in Orange County. Plaintiff’s application to the Superior Court in Los Angeles County, where judgment was entered, is improper.
