TENTATIVE RULING ON MOTION TO COMPEL

The court denies the motion without prejudice. 

The verification is signed by a person who states under oath that he has the corporation's power of attorney.  At this point, that is sufficient.  If propounding party conducts discovery and determines that the verification was signed without authority, the court will be receptive to a motion for some type of remedy.  It is not the purview of the court on this motion to make a factual determination of the validity of the power of attorney but only that the responses were verified and there were facts stated under oath as to apparent authority.  No sanctions to either side as both sides had legitimate arguments in their favor. 

The court sustains all objections to the declaration of Mr. Queen.
