TENTATIVE
RULING ON MOTION FOR RECONSIDERATION
The
instant motion for reconsideration was filed on September 27, 2022. On the same day, Plaintiff also filed the
First Amended Complaint (FAC) and Summons on the FAC. The FAC replaces the Complaint and the FAC is
the operative pleading. On September 30,
2022, Plaintiff filed the proof of service (POS) as to the FAC. Because Plaintiff filed the FAC, the summons
on the FAC and the POS as to the FAC, the issues related to service of the
Complaint and original Summons are moot.
Therefore, the motion is denied as MOOT.
