The court grants the ex parte application to advance the hearing on the demurrer which, by Code for a UD in possession, should be on 5 days’ notice.

Having advanced the hearing, the court notes there is no reply to the opposition to the demurrer which is incorporated into the ex parte application.  The court would be inclined to grant 2 days to file a reply(10/6/2022).  Therefore, tentatively, the hearing will be advanced to 10/10/2022 at 8:30 a.m.

Mr. Isaacs is ordered forthwith to file the opposition to the demurrer as a separate document.

The court notes that there is a Motion to Consolidate reserved for 11/7/2022 but that no Notice of Related Action has been filed, as required before consolidation, under both case numbers.  See California Rules of Court 3.300.
