[TENTATIVE] ORDER:  Plaintiff Cashmere Valley Bank’s two Applications for Writs of Possession against Defendants VGK Express Inc. and Gratch Karmrian are taken OFF-CALENDAR.  Plaintiff Cashmere Valley Bank is instructed to proceed by way of default judgment.

 

 Introduction

            Plaintiff Cashmere Valley Bank (Plaintiff) applied for two separate writs of possession against Defendants VGK Express Inc. and Gratch Karmrian (collectively, Defendants.)  Defendants did not file an opposition.

  Procedure

            Plaintiff’s applications for writs of possession were filed on April 12, 2023.  However, defaults were entered against Defendants on May 3, 2023.  With defaults being entered against Defendants, Defendants are now “out of court.”  Defendants are not permitted to appear and oppose the instant applications without setting aside the defaults.  Because Defendants are deprived of their opportunity to be heard, the applications for writs of possession are no longer proper and not considered. 

            The two applications for writs of possession are taken OFF-CALENDAR by the Court.
