[TENTATIVE] ORDER:  Receiver Stephen Donell’s Motion to Employ Counsel is GRANTED.

Introduction

            Receiver Stephen Donell (Receiver) moved to employ the law firm of Smiley Wang-Ekvall, LLP (Counsel.)  

            Discussion 

            Receiver requested to employ Counsel pursuant California Rule of Court, rule 3.1180.  Receiver asserted that Counsel is required to assist with compelling the production of documents from third parties by subpoena, expanding the scope of the receivership estate as necessary, and to assist with the prosecution of claims to recover assets, including a fraudulent transfer action.  Receiver further provided that Counsel is not an attorney  for, associated with, nor employed by an attorney for any party.  The Court finds that the Receiver’s motion complied with the three requisites in the Court Rule (i.e., “(1) The necessity for the employment; (2) The name of the attorney whom the receiver proposes to employ; and (3) That the attorney is not the attorney for, associated with, nor employed by an attorney for any party.”)  Due to Receiver’s compliance with the requirements of the rule, the Receiver presented good cause for the employment of Counsel.

            The motion to employ counsel is GRANTED.
