Tentative
ruling on motion to vacate filed on 9/26/2022:
Deny with prejudice on the grounds that the evidence that was submitted
supports the court’s ruling. The court
finds that there has been sufficient evidence submitted to establish that plaintiff
has the ability to pay the arbitrator’s fees out of funds which are not
ordinarily reserved for the common necessaries of life. There was no excusable neglect. Plaintiff was
given a fair opportunity to establish that she has the inability to pay the fees. Plaintiff clearly indicated that she would
not be complying with the discovery and improperly redacted information from
her bank statements. Despite that, there was sufficient information for the
court to make the determination that she does not qualify for a fee waiver based
on her income. Those facts are set forth
in detail in the 8/18/2022 motion. No further motions may be filed with respect
to the court’s ruling of 8/18/2022.
