Case Number: 19STLC02362    Hearing Date: September 13, 2022    Dept: 19

Defendants' unopposed Motion For An Order That The Genuineness Of The Documents And The Truth Of The Matters Specified In Defendants' Request For Admissions, Set One, Numbers 1-26, Be Deemed Admitted is GRANTED. (Code of Civ. Proc. section 2033.280(b).)  The Court grants the request for monetary sanctions in the reduced amount of $1,810.00 against Plaintiff Vaheh Gerami, since no opposition was filed, payable within 30 days through Defendants' counsel of record.  (Code of Civ. Proc. section 2033.280(c).)  The Court declines to impose monetary sanctions against Plaintiff's counsel, as notice of the identity of that person was not specifically given or named. (Code of Civ. Proc. section 2023.040).  The Court does not rule on the alternative relief requested.

Order signed this date.

The Court finds that the responses contain partial objections to the requested admissions, but are not verified as required under Code of Civil Procedure section 2033.240(a).  Further, the responses were untimely, hence the objections have been waived. (Code of Civ. Proc. sections 2033.250(a); 2033.280(a).)  Lastly, the Court finds that the untimely responses are not in substantial compliance with sections 2033.210, 2033.220 and 2033.230).

Moving parties to give notice.
