A. A.   A.   After consideration of the briefing filed and oral argument at the initial Final Status Conference, the Court will rule as follows on Plaintiff’s Motions in Limine. (To be included in the Minute Order filed on 12/01/2022).

 1.     Plaintiff’s Motion In Limine No. 1 To Exclude Evidence and Argument As To Films, Agreements, Payments, And Facts Other Than For Sin City II: A Dame To Kill For is GRANTED in part.  All evidence regarding films other than for Sin City II: A Dame to Kill including distribution agreements, contracts, history of other films, and payments is excluded, except the Court will conduct a 402 hearing regarding evidence Defendants would intend to present at trial limited to the films “Machete Kills” and “Dyatlov Pass Incident” as to their state of mind in the summer of 2014. (To be included in the Minute Order filed on 12/01/2022).

 2.      Plaintiff’s Motion in Limine No. 2 To Exclude Evidence And Argument Regarding A Demarest Loan And Monies Associated With It is GRANTED. (To be included in the Minute Order filed on 12/01/2022)


B.       Other Issues to Be Argued and Ruled Upon at the upcoming Final Status Conference on December 1, 2022:

 1.
     Remaining Motions in Limine and Disputed Jury Instructions. Meet and confer efforts are required, and must be completed before  December 1, 2022.

Defendants’ Intention to Offer Video Recording of the Deposition of Dmitry Konstantinov At Trial and Plaintiff’s Objection

 3.
      Plantiff’s Request for Judicial Notice of Trial Exhibit 131.

 4.      
Defendants’ Request for Recognition of Russian Judgment Under Uniform Foreign-County Money Judgments Recognition Act and Plaintiff’s Objection.

 5.     
Defendants’ Request for Judicial Notice of Moscow City Arbitration Court Decision and Plaintiff’s Objection


C.      Agreed Upon Issues:

 1.      The Court approves the Joint Statement of the Case filed on 10/27/2022.

 2.      Pursuant to the Stipulation of the parties filed on 10/04/2022, there will be a bifurcation of the liability and punitive damages phases of trial.
