On the Court’s own motion, the Hearing on Motion for Summary Judgment is CONTINUED to September 19, 2022, at 8:30 a.m. in Department 19 of the Stanley Mosk Courthouse.

Except for the declaration of Dennis Rosterbach, ALL of  the moving papers filed by Defendant Freightliner Custom Chassis Corporation on June 1, 2022 (the Separate Statement of Undisputed Material Facts, the Proof of Service of Motion, the Notice of Motion and Motion, the Memorandum of Points and Authorities, the Notice of Lodgment, and the Declaration of Scott J. Loeding), are illegible and do not comply with the California Rules of Court governing the form and format of electronically filed papers. (See Cal. R. Ct., 2.105 [“The font style must be essentially equivalent to Courier, Times New Roman, or Arial.”].)  The Court is unable to read the electronically filed papers.

In addition, the electronically filed papers are not text searchable, as required by California Rules of Court, rule 2.256 and the operative Los Angeles Superior Court General Order re Mandatory Electronic Filing for Civil. 
Counsel for Defendant Freightliner Custom Chassis Corporation is ordered to refile and serve these documents that are legible and text searchable by August 31, 2022.  (Only courtesy copies of the opposition briefing and reply briefing are needed).

The Court also advances and CONTINUES the Post-Mandatory Settlement Conference (MSC)/Mediation Status Conference to October 4, 2022, at 9:30 a.m.  The Court expects the parties to have completed a Mandatory Settlement Conference (or Private Mediation) before that hearing date, as ordered on January 25, 2022. No exceptions. If the parties have not signed up for an MSC, as directed in the January 25th minute order,  the Court advises the parties that they are running out of time to do so.  As an alternative, the parties may be referred by the Court to the Early Resolution Employment Case MSC Program with Resolve Law LA. The parties must file a Stipulation and Order, by August 19, 2022, if the referral and good faith participation 
is agreed upon by the parties .
