On the Court’s own motion, the hearing on Defendant Heffernan Insurance Brokers' Motion for Summary Judgment, scheduled for December 19, 2022, is CONTINUED to January 10, 2023, at 8:30 a.m. in Department 19 of the Stanley Mosk Courthouse.

The Court cannot rule on the motion because Defendant Heffernan Insurance Brokers failed to file their evidence in support of the motion. Rather, it was only lodged with the Court.  All evidence must be formally filed to be considered by the Court. 

Defendant Heffernan Insurance Brokers is ordered to formally file the evidence lodged in support of the motion on or before December 30, 2022. 

Further, the Court notes that Defendant's request for judicial notice failed to provide copies of the material involved. If Defendant wants to preserve this issue for appeal purposes, providing a link is insufficient. (Cal. Rules of Court, rule 3.1306(c).) 

Lastly, if any party seeks to file a document or record under seal, they must follow the procedures set forth in California Rules of Court, rules 2.550 and 2.551, and make the requisite showing.
